A. introduction

The  batyaar.com website (hereinafter: "the website") operated by Noa Rees Berger, PO Box 053066551, from the address of 37 Yogav, Meshgav Dov (hereinafter: "the website management" and/or "the company" and/or "the studio" ). Any use of the site constitutes acceptance of these regulations, the terms and conditions contained therein.

The customer is any person, including a corporation, who may perform operations through the website (hereinafter: the "customer" and/or the "orderer"), who has reached the age of 18. A minor who performs actions will be considered a minor who has received the permission of his parents/guardians to make the purchase on the website.

The regulations may change from time to time, and the user must update the regulations every time he enters the website. Browsing the website and/or using it of any kind, like them as an agreement to the terms of the regulations and a commitment to act according to them. It is clarified that the regulations constitute a binding legal agreement for all matters and obligates the user for all his use of the website.

  • What is stated in these regulations in the masculine language is for convenience only and the regulations refer to members of both genders equally.

  • The services through the website are subject to the conditions detailed in these regulations.

  • Ordering products/services on the website will constitute a statement by the customer that he has read the instructions of this regulation, understood them and agreed to them before the purchase. The regulations constitute a binding contract between the user and the website management.

 
 
B. the services

  • The site offers handmade products for sale and craft workshops.

  • You can book workshops at the studio located in Meshgav Dov, by contacting the studio and depending on its availability.

  • You can pay for the site's services by credit card, subject to the approval of the site's management.

  • The prices of the products appearing on the website are prices including VAT according to the law. The quoted prices are in new shekels and do not include shipping fees.

  • The website management reserves the right to terminate its services at any time.

  • The right to use the website is, as mentioned, for any person who has reached the age of 18. An order will be possible for those who have an active bank account and/or have a valid Israeli credit card and have an e-mail address whose address will be provided at the time of purchase on the website. A minor who performs actions will be considered a minor who has received the permission of his parents/guardians to make the purchase on the site.

 
third. Cancellations and returns

Cancellation of a transaction made on the website will be in accordance with this chapter and subject to the Consumer Protection Law 1981 (hereinafter: "Consumer Protection Law").

The customer will be entitled to cancel an order placed on the website in one of the cases and under the conditions below:

  • Cancellation of an order will be possible up to 24 hours from the date of placing the order, provided that the order has not been shipped. Financial credit will be given according to the law.

  • In the event that cancellation of the transaction is required after the product has been sent to the customer, and up to 48 hours after the purchase, the customer must send the product back by courier service at a cost of NIS 30, and this is at the customer's expense. The customer will contact the studio by phone at 0543954022, in order to coordinate a time to collect the items by a courier. After receiving the goods back, and provided that they have not been used/defective, the customer will be given a full monetary credit.

  • In case of cancellation of a workshop, up to 48 hours before the scheduled date, the customer will not be charged for the service. Cancellation within a time frame of less than 48 hours from the scheduled date, the customer will be charged 30% of the workshop cost.

  • It is not possible to receive a refund for a workshop that took place.

 
 
d. Exchanges

An exchange can be made, for any reason, and provided that the product is not used/defective, in several ways:

  • Arriving at the studio within 14 business days from the day of purchase, along with the purchase invoice received by email, and make an exchange or receive a refund. This option does not involve an additional fee.

  • Exchange by courier: the customer will be sent an email toreis.noa@gmail.com And after receiving approval for the exchange, he will place a new order on the website. The customer must hand the product back to the courier, when receiving the new order. After receiving the goods back, and provided that they are not used/defective, the customer will be given a full monetary credit for the product. No refund will be given for shipping.

 
God. Shipping Policy 

  • The products on the site are ready for delivery within 2 business days.

  • The delivery of the products will be within the delivery time chosen when placing the order, which the company has committed to.

  • You can choose a type of delivery: self-collection from the business or home delivery.

  • Shipping costs are as shown on the payment page.

  • The supply of the products is subject to the completion of the purchase process, provided that the customer owns a valid credit card that can be debited and settled in Israel, and provided that the credit card company that issued it approved the transaction.

 
and. Warranty and service 

  • The company makes every effort to describe and present the products on the site as accurately as possible. However, the images are for illustration purposes only, and there may be differences between the colors and details shown on the screen and the reality.  The company will not be responsible for any mistake made in the product description on the website

  • The website management is not responsible for physical or financial damages or any other damage caused during the use of the website and/or following the use of the products/services provided by the company.

  • The company is not responsible and will not be responsible for delays in the delivery of products as a result of events beyond its direct control. Including in the case of strikes, natural disasters, malfunctions in the computer system, malfunctions in the telephone systems or malfunctions in the electronic mail service, which have the potential to impair the completion of the purchase and delivery to the customer.

  • The company undertakes that it will do its best to deliver the products on the promised date. If the customer believes that the products he purchased on the website or services he received are defective, he is invited to contact the studio by phone at 0543954022 or by email at reis.noa@gmail.com during business hours (Sunday-Thursday between the hours of 9:00-17:00), and his request will be answered early.

G. Information security and privacy

  • The management of the site and other sub-factors acting on behalf of the company, may use the information appearing in the form in order to bring you the requested information and services. This personal information will not be disclosed and will not be used further for marketing purposes without permission and will not be transferred to a third party without express permission from the customer.

  • The content of the service and the disclosure of personal information during the service will never be disclosed to another person or any party without written permission from the customer. The website administration is committed to your privacy and this privacy is our top priority.

  • The company undertakes not to make use of the information provided to it by the buyers except in order to enable the purchase on the sales site and in accordance with any law.

  • By clicking the "Send" button, I confirm with my signature the form and its conditions.

  • The site is secured through the use of advanced security measures, the purpose of which is to ensure proper use and safe browsing of the site, as well as to maintain the privacy of the users. All users of the website and its services undertake that they will not do any activity to disrupt the activity of the website, steal information about users and hack the website's security mechanisms.

  • In the event of misuse, the website management will act against any activity in any legal way at its disposal, including blocking the user from accessing the website and taking legal proceedings against the user if he acts as stated.

H. Intellectual Property

  • All intellectual property rights on this website, including copyrights, distribution rights, trade secrets, trademarks and all intellectual property of any kind, both regarding the design and page of the website, as well as regarding the contents that appear on it, are the exclusive property of the website management.

  • Do not copy, reproduce, distribute, publish or use in any other way any information from the site and/or from the site, unless consent to this has been given in advance and in writing on behalf of the site management.

ninth. Law and Jurisdiction

The interpretation and enforcement of these regulations and/or any action or conflict arising from it will be done in accordance with Israeli law only and the competent court in the Southern District will have exclusive jurisdiction.
